Terms of Use

These conditions apply whenever you browse the website, read its material, or use a search feature. Continued use signals your agreement. If you do not agree, stop using the site.

NO FCRA USE. This privately operated website has no government affiliation. It and its advertising partners do not offer a service for credit, employment, insurance, tenant, or other decisions regulated by the Fair Credit Reporting Act (FCRA). The material points readers to Doña Ana County and New Mexico record resources. We are neither a private investigation firm nor a consumer reporting agency.

1. What This Website Is

This private reference site is independent of every public office. It does not hold official criminal records, retrieve documents, perform official checks, or submit filings.

The content identifies the agencies that keep Doña Ana County records, including law enforcement, New Mexico Courts, NMDPS Law Enforcement Records Bureau, and the New Mexico DPS Sex Offender Registry. New Mexico IPRA, NMSA 1978 §§14-2-1 through 14-2-12, governs requests made to public bodies. NMSA 1978 §29-10-6 governs access to a person's own state arrest information. Neither law makes this private site a record custodian.

2. Rules for Using This Site

By using the site, you agree not to:

  • Use automated bots or scrapers against the pages
  • Violate a federal, state, or local law
  • Harass, threaten, or stalk a person with information found here
  • Use the content for employment, housing, lending, or insurance decisions
  • Attempt unauthorized access to any system
  • Disrupt performance or prevent others from using the website

3. No Harassment, Stalking, or Discrimination

You may not use site content or a linked tool to stalk, harass, intimidate, threaten, or discriminate against anyone. Misuse can be a crime. New Mexico's Sex Offender Registration and Notification Act, NMSA 1978 §§29-11A-1 et seq., controls registry dissemination. Public registry information supports safety awareness. It does not authorize vigilante conduct, employment blacklisting, or housing discrimination.

4. We Are Not a Consumer Reporting Agency

We are not a consumer reporting agency under the FCRA and create no credit report, background check, or consumer report. Our advertising partners and this site do not provide tools designed for job applicants, rental applications, insurance rates, or credit decisions. Data from the website or a linked feature may not be used to:

  • Set insurance terms or assess creditworthiness
  • Make a hiring or termination decision
  • Evaluate a renter or housing applicant
  • Decide eligibility for a permit, license, or government benefit
  • Carry out any other FCRA-regulated activity

A lawful regulated check must come from the proper official channel or a provider that complies with the FCRA and all applicable law.

5. No Legal Advice

The material is not legal advice. It cannot determine how a Doña Ana County charge, warrant, conviction, or expungement provision applies to a specific set of facts. Seek advice from a licensed New Mexico attorney.

6. No Warranties

All material is offered "as is," without a guarantee that:

  • A partner's search results will be complete or accurate
  • The content is always complete, accurate, and current
  • Every page is free from bugs, errors, or security flaws
  • Access will be continuous and uninterrupted

Charges can be filed, changed, dismissed, sealed, or expunged after publication. Gaps and delays are possible. No statement here is an official statement of a court, sheriff, police department, or New Mexico agency.

7. Third-Party Services and Links

Links may lead to law enforcement, courts, government agencies, legal resources, and outside search providers. We do not control those destinations and are not responsible for their availability, fees, data practices, or content. Review a destination's terms before using it.

8. Intellectual Property

Doña Ana County Criminal History or its content partners own the site's text, graphics, logos, and code. Written permission is required before copying, modifying, distributing, or creating derivative material.

9. Limits on Our Liability

To the maximum extent allowed by law, we are not liable for damages arising from use of the site, its content, or a linked service.

10. Indemnification

You agree to indemnify and hold us harmless from a claim, action, or demand caused by your use of the website or violation of these terms, including related legal fees and costs.

11. Governing Law

New Mexico law governs these terms. Any dispute tied to website use must be brought in a court located in New Mexico.

12. Changes to These Terms

We may revise these terms. A revision becomes effective when posted on this page.

13. Cutting Off Access

Access may be limited or terminated at any time, for any reason, without advance notice.

14. Severability

If any provision is held invalid or unenforceable, the remaining provisions stay effective. The affected text will be narrowed only as needed to make it enforceable.

15. Questions

Questions about these conditions may be directed through the Contact page.
